In 2008, three years after their arrival in China, its leaders realised their flagship product, as well as their website, and even their business cards had been copied and sold by someone else on the Chinese market With the help of a lawyer, the company managed to stop the copies, but they soon returned. Tom Meyer, the company's General Manager in China, was not discouraged though and participated in a seminar organised by the China IPR SME Helpdesk, which helped him to understand what he should do." "We started registering our logo, our name, the copyright for the hardware, and the copyright for the software," he said. Tom finally managed to get rid of around 95 percent of the copies. And now works profitably and with peace of mind. "We probably invested the equivalent of 3,500 US dollars (2,700 euros) and our return on investment, I would say, was increase of revenue by 20 or 25 percent." For more on the protection on Intellectual Property Rights (IPR) in China, we look to the European Chamber of Commerce in Shanghai. The China IPR SME Helpdesk is a project set up by the European Commission. It aims to provide advice and information about intellectual property rights for European SMEs who settle in China. All services are free and available in six European languages ​​plus Chinese. There is no technical or legal jargon, just simple and useful information. Each year, the organisation advises around 500 SMEs directly and gives information to some 3,000 more. Naomi Saunders, the Project Manager for the Helpdesk said: "European SMEs really need to apply for their trademarks in China even before they arrive on the ground here, in order to protect (themselves). Basically, if you don't register it, somebody else will." In China it's the first to register a trademark has the right to it, a trademark registered in Europe is not protected in China. It is therefore necessary to re-register on site. "For example, the administrative fee to register a trademark here in China is around about 100 euros depending on the trademarks, so it is not too expensive," Naomi added. Tom Meyer of Lauterbach ends the piece with some very wise words: "To me, the key to success is registrations - rather more than too few. Once you've done that you should enlist the help of various reputation management firms. They used to be trademark watch services and now it's just taken a step further because of all the online defamation that takes place and disparagement of different products. Those companies will do the Google alerts; they'll have someone monitoring the web to ensure that your brand is being used in accordance with your policies and the way you want. So, I would do those things, I would register every domain name possible -- including disparaging ones so that someone else can't buy them. So, if you're Saper Law you should go and buy saperlawsucks.com. Do you own that one? I don't, I should though! As I was telling that I was thinking, gee, I haven't done that myself! I think it's something that's silly but it's a ten dollar investment or however much domain names go for these days, so that it again helps you manage your business in the online context.

The aim is to streamline the patent and trademarking process to give Korean companies an edge in the global market, while cracking down on counterfeit goods. Our Paul Yi shows us how local firms are responding to the new changes. Even though KT is one of Korea's leading telecommunications companies, its iconic brand had been denied a trademark registration due to a lack of letters in its name. However, the Korea Intellectual Property Office says its revamped screening process will no longer hold back local firms. "KT and other short English names will have easier screening standards. This will be extremely helpful to companies with respect to brand development and management." Other big brands such as GS and NHCard have only recently received trademark approval, after years of jumping through hoops. KIPO officials say they've now cut through the red tape and improved their customer service. "Since Korean IP Office examiners are able to use their power to correct and quickly resolve issues, it seems to have greatly reduced the burden in terms of cost and time." Protection of intellectual property rights is crucial to a fair competitive market and to preventing the spread of counterfeit products. "The quality of one's product is indirectly represented through its brand. That's why I think it's a good decision to have a screening policy that permits a broad trademark registration process." It's all part of a massive reorganization at the nation's leading patent office that's focused on providing easier and faster access. The typical trademark and design patent review periods have been reduced by three and five months, respectively. The KIPO also plans to submit a comprehensive bill to the National Assembly next year to further streamline Korea's patent system. "We will prohibit counterfeit products of creative brands and designs. We will also strengthen our screening evaluations in order to give Korean companies a competitive edge in the global marketing field." The KIPO says it's doing its part to realize the government's vision of a creative economy, by paving the way for local companies to embrace emerging trends and innovative technologies. Patents, trademarks and copyright are actually very different kinds of things from one another. What unites them is that they help entrepreneurs and business owners protect their intellectual property. But how patents, trademarks and a copyright function, and the role they play has very little overlap. The reason it is important to do a tutorial explaining the difference between a patent, trademark and a copyright is that patents, trademarks and a copyrights often get confused one for another by first-time entrepreneurs, and the explanation of the differences between these legal tools has to happen time and time again. A patent is used to protect an invention. The invention has to already be created. So it can't be a business idea for an invention. The patent must be used to protect the actual invention, or something in the invention. There are provisional patents that allow you to get started patenting your invention earlier. But overall, patents are meant to protect actual inventions. Trademarks are meant to protect logos, business names, and business slogans. And a copyright is meant to protect a body of writing such as a book. A copyright is also meant to protect something you write that may be found online. A trade secret is something that one company has and no one else does. For example, McDonald's secret sauce of Coca-Cola's recipe for Coke. Another category is copyright. Copyright includes the duplication of concepts and even physicality of a product. Another type of intellectual property is trademarks. A trademark is a label such a brand name (like Pepsi) or a symbol (such as the Nike swoosh). These are also protected properties of a company. Finally, patents are intellectual property.
