A trademark is a distinguished word, phrase , a symbol , a fragrance or a logo , or a combination of these elements. which is used in trade/business , to indicate the origin/source of the brand, in order to distinguish and identify the brand owner in the market. Trademark law protects the consumer, by preventing the public confusion , as to the origin or quality of a product. and it also reward the brand owner , by maintaining his business successful reputation in the market. Trademarks legally conflict with each other, if the use of one trademark causes public confusion as to the product being offered in the market ( likelihood of confusion ) The american law protects trademarks even if its not registered, which is also known as the Common Law Trademark Rights, in this case registration is not required to establish trademark rights, seeing that the first who use a trademark in commerce owns it. On the other hand, Most countries require registration of a trademark , as it provides legal certainty and reinforces the position of the right holder . therefore any subsequent users who cause confusion as to the product or its origin , will be forced to stop using the mark , and might be liable to pay the trademark owner damages. Lastly, Trademark is not absolute as its subject to various limits and defenses, such as abandonment, limitations on geographic area in which the mark is used , and fair use , which means that the more common and generic the word is , the less likely the trademark owner may be able to regulate it. This doctrine also protects "nominative" use of the trademark name, as is often done by competitors in marketing materials.

Our review reveals six perspectives that have informed past studies: a game theoretic, a strategic, a macro-cognitive, a micro-cognitive, a cultural-sociological, and communicative one. We compare and contrast the different assumptions about what reputation is and how it is formed that characterize these perspectives, and we discuss the implications of these differences for our theoretical understanding of stability and change, control and contestation, and the micro-macro relationship in the complex process of reputation formation. We discuss how the integration among these perspectives, through their positioning, blending, and alignment, may enhance our theoretical understanding of this phenomenon.

However, its extremely important to know that a visual brand will not be effective without a strategy behind it and that’s where marketing comes in. I like to think about a visual brand as the the beauty and the marketing as the brains of your business. Generally, your visual brand represents who you are and what you stand for and marketing is how you build awareness about your brand. As important as it is to have a professional visual brand, you also need a consistent marketing strategy in place to create awareness of your brand by building relationships with your audience over time and positioning yourself as the go-to expert that you are. In order to have a successful brand presence your marketing and visual brand very much need to work together. So what exactly is the difference between marketing and visual branding? I have come up with a simple example that begins to explain the difference between the two. Marketing - is consistently promoting and occasionally selling your products or services. It provides brand awareness while providing education and value to your audience or potential customers. With marketing, you are you telling your audience what you want to be know for. Let’s say you own an accounting business. In your case, your marketing might have a consistent message that You know how to save your customers money during tax time. Branding on the other hand is how your customer perceives you, really its your reputation. Branding is when a potential customer might tell you: ‘I hear that you can help me save money on my taxes’ A great marketing strategy starts from being crystal clear on the basics of your brand. Knowing your brand basics, provides an effective direction for your visual brand and gives you great direction for your marketing strategy that aligns with your core brand values.
